What a POD should include

Five things every proof of delivery should show.

A proof of delivery (POD) is the receiver's signed acknowledgment that the load arrived. To settle a dispute later, it has to tie that signature to one trip and one moment.

  1. The trip it belongs to.A trip number, the client, and the pickup and drop-off points, so the receipt can't be confused with another run that day.

  2. What was handed over.The cargo as booked, plus any shortage or damage the receiver writes down before signing.

  3. Who received it.The receiver's printed name and signature. A scribble with no name is hard to stand behind months later.

  4. When it was received.The delivery date and time, which also shows whether the drop-off met the agreed schedule.

  5. A photo anyone can read.The whole receipt in frame and in focus, with the signature and remarks legible, taken before the driver leaves.

Why the signature matters

What the law says about delivery and electronic records.

The signed receipt marks the moment a carrier's responsibility for the goods ends, which is why trucking offices hold on to it.

  1. Responsibility lasts until delivery.Under Article 1736 of the Civil Code, a common carrier's responsibility for goods lasts until they are actually or constructively delivered to the consignee or the person entitled to receive them.

  2. Fault is presumed for lost or damaged goods.Under Article 1735, if goods are lost, destroyed or deteriorated, a common carrier is presumed at fault unless it proves it used extraordinary diligence.

  3. Electronic records count.Section 7 of the Electronic Commerce Act gives electronic documents the legal effect of paper ones, provided their integrity and reliability can be shown.

It's the delivery record kept digitally rather than on paper alone. In trucking, that usually means a photo of the signed delivery receipt, attached to the trip it closes.

The trip number, the client, what was delivered, the receiver's name and signature, and the date and time. The photo should show the whole receipt clearly.
