The rules

What Marikina's junkshop ordinance asks of a yard.

Ordinance No. 057 replaced Ordinance No. 80, Series of 2006. It covers where a junkshop may run, how the junkyard is built and kept, and the people who work there.

Zones, hours and loading

  • Commercial and industrial zones only, and never on the main thoroughfares listed below
  • Open from 8 AM to 5 PM only
  • A loading and unloading slot inside the premises, never on roads or sidewalks
  • The five-meter setback is for parking only, with no walls or fences built in it

The junkyard

  • At least 100 square meters
  • Junk stored inside an enclosed, paved area, at least six inches off the ground on pallets or racks
  • Stacks no higher than the firewall
  • A firewall of 6-inch concrete hollow blocks, and wiring that meets the Philippine Electrical Code

Staff health and safety

  • Employees at least 18 years old
  • Health certificates for the operator and staff from the City Health Officer, renewed every year
  • Safety shoes, gloves, dust masks and shirts with sleeves
  • A separate toilet, hand-washing area and dining area for staff

Records and trading

  • Proper keeping of all records, as local and national government agencies require
  • Traders, the eco-aides with capital to buy junk, sell what they buy within the day
  • Scavengers may not follow garbage trucks or take from garbage set out for collection

Permits and penalties

Getting the permit, and what a violation costs.

Junkshops are on the BPLO's list of businesses with extra requirements for a business permit.

  • Certificates of compliance. Junkshops need a Certificate of Compliance from the City Engineering Office, the Bureau of Fire Protection, the City Health Office and the City Environmental Management Office (CEMO), on top of the zoning clearance in the BPLO's standard checklist.
  • Fines. ₱2,000 for a first offense. After a notice of violation, the yard has seven days to fix the problem. If it doesn't, the business is closed, its permit to operate is revoked and the structure is demolished.
  • Companies. For a corporation, partnership or association, the penalty falls on its erring officers.
  • Waste water. Waste water discharged onto streets or into bodies of water, if it's likely to affect health, is a nuisance to fix within 24 hours.
  • Who enforces it. The BPLO, the City Engineering Office, the City Health Office and CEMO, with the City Legal Office and the Office of Public Safety and Security.
